IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree that any arbitration or proceeding shall be limited to the dispute between you and WowMath individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12.4 Jurisdiction

If arbitration is not applicable, you agree to submit to the personal jurisdiction of the state and federal courts located in Ohio, United States, and waive any objection to venue in such courts.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Provide a reasonable period for you to review the changes

• Behavior that harms WowMath or other users

14.3 Effect of Termination

Upon termination, all licenses and rights granted to you will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and WowMath regarding our Services and supersede all prior agreements and understandings.

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and you do not have any authority to bind WowMath in any manner whatsoever.

15.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, or governmental actions.
